JumpTime, Inc. (“JumpTime”, “we, “us”, “our”) operates the website located at www.jumptime.com (“the Site”). Please carefully read this privacy policy (“Privacy Policy”) to understand what information JumpTime collects, how the information is used, and what choices you may have regarding the collection and use of your information when using or visiting the Site.

By accessing or using the Site, you are accepting the terms and conditions of this Privacy Policy and JumpTime will have the right to use your personal and other information as described in this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, you must immediately discontinue your access to and use of the Site.

  1. SCOPE

    This Privacy Policy covers personally identifiable and non-personally identifiable information collected by JumpTime when you visit or use the Site. If you are a JumpTime customer using one of our Optimization Platform products, then you are also subject to the terms and conditions of the applicable JumpTime License Agreement between you and JumpTime and the terms of the License Agreement will supersede the terms of this Privacy Policy.

  2. NO INFORMATION COLLECTED FROM CHILDREN UNDER 13 YEARS OF AGE

    The Site is a general audience site. JumpTime does not knowingly collect personal information from children under 13 years of age. If JumpTime learns or believes that it has collected personal information from a child under 13 years of age, JumpTime will delete that information as quickly as possible.

  3. INFORMATION WE COLLECT

    JumpTime may collect both personally identifiable information as well as non-personally identifiable information when you visit or use the Site.

    1. Personally Identifiable Information

      Personally identifiable information (“PII”) is any information that would allow a third party to identify or locate a specific individual. PII includes, without limitation, your full name, email address, mailing address and telephone number. JumpTime only collects PII if that information is voluntarily provided by you. This may happen in several ways:

      • User Account

        In order to access and utilize certain products or services provided by the Site, you may be required to create a user account and to provide your full name, an email address, a user name and/or a password. It is solely your responsibility (and not the responsibility of JumpTime) to maintain the confidentiality of your password and username.

      • Contact Us

        If you submit a query or comment to JumpTime via the Contact Us function, PII may be collected in order for JumpTime to respond to you.

      • Public Forums

        A user may submit PII in the process of posting a message on a public forum on the Site, such as message boards.

    2. Non-Personally Identifiable Information

      Non-personally identifiable information (“Non-PII”) is any information that does not specifically identify an individual.

      You can visit the Site to read information about JumpTime and our products and services without revealing any PII. However, during your visit to the Site, JumpTime may collect anonymous Non-PII such as the activity of your browser when you are viewing the Site; your site path during your visit to the Site; general information regarding your internet service provider and host, demographic data, and the time you spend on the Site. The Non-PII may be collected by JumpTime in several ways:

      • Log files

        Any time you visit the Site, our servers may automatically gather information from your browser (such as your IP address, browser type, internet service provider, referring/exit pages, platform type, date/time stamp, number of clicks, etc.). This information and clickstream data may be logged by JumpTime.

      • IP Address Logging

        JumpTime may collect your computer’s IP address and record this information in its log files.

      • Cookies

        JumpTime may utilize cookies to monitor your activity during your visit(s) to the Site. Cookies are text files placed in your computer’s browser to identify your Internet browser and to store your preferences.

      • Beacons

        JumpTime may also use “web beacons”, clear.gifs, or similar technologies, to track the activity and flow of your visit to the Site. “Web beacons” and clear.gifs are small pieces of code placed on a web page, to monitor the behavior of and to collect data about the visitors to that page.

  4. INFORMATION COLLECTED BY THIRD PARTIES

    1. General

      JumpTime may use the services of third parties for various purposes, including, without limitation, to provide JumpTime with data collection and reportings and to assist with the delivery of relevant marketing messages. These third parties, or JumpTime on their behalf, may view, edit or set their own cookies to monitor your activity during your visit to the Site. Additionally, these third parties, or JumpTime on their behalf, may place web beacons, clear.gifs or similar technologies on the Site. JumpTime does not control the foregoing third party monitoring technologies or the information which they may collect and JumpTime has no responsibility or liability in connection with the foregoing. A third party’s use of the foregoing monitoring technologies and the information collected is subject to the third party’s own privacy policies and is not covered by this Privacy Policy.

    2. Yahoo Third-Party Web Beacons

      JumpTime uses third-party web beacons from Yahoo! to help analyze where visitors go and what they do while visiting the Site. Yahoo! may also use anonymous information about your visits to the Site and other websites in order to improve its products and services and provide advertisements about goods and services of interest to you.   5. HOW WE USE YOUR INFORMATION

    JumpTime may use the PII and non-PII it collects on the Site as follows:

    1. Use Of Your PII
      • JumpTime may use the PII you share with us to provide you with services and products. In the case of public forums, the PII you provide to us may be used to manage your account and to uniquely identify your posts for other users.
      • JumpTime may use the PII you share with us to respond to your comments or requests for information, etc. If a comment or request is made by email, we may respond by sending an email response back to the sender. JumpTime may store the emails we receive for archival purposes and also for marketing purposes if we feel that this is consistent with the nature of the comment/request.
      • JumpTime may share your PII with JumpTime’s affiliated entities if JumpTime has a business reason to do so.
      • JumpTime may share your PII with its trusted third party service providers that assist JumpTime with the management, operation or administration of the Site; the analysis of the performance of the Site; and the provision of the JumpTime products and services. However, these third party service providers do not have any independent right to share this information and are required to treat your PII as confidential, to maintain appropriate security measures and to not use your PII for any purpose that is not consistent with this Privacy Policy or authorized by us.
      • JumpTime does not rent, share, or sell the PII you share with us other than as provided by this Privacy Policy unless you grant JumpTime your prior permission.
    2. Use Of Your Non-PII
      • JumpTime may measure and analyze aggregated statistical Non-PII from your visit to the Site in order to administer the Site, improve the quality of our services, improve the Site’s performance and improve your experience on the Site, such as providing more relevant content to you during your visit to the Site.
      • JumpTime may use and/or share anonymous, aggregated and/or un-aggregated Non-PII with third parties for any and all reasonable business purposes as JumpTime determines in our sole discretion, including, without limitation, advertising, promotion, business opportunities, etc.
    3. Other Permitted Disclosures Of Information

      Additionally, JumpTime may disclose the information it collects on the Site, both PII and Non-PII (collectively “User Information”), under the following circumstances:

      • JumpTime may disclose any or all User Information if permitted by law; if required by any legal process or valid order of a court or other governmental body; to establish or exercise any of JumpTime’s legal rights or to defend any legal claims made against JumpTime.
      • If JumpTime sells all or a part of its business or makes a sale of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business), then as part of the applicable transaction, JumpTime may transfer your User Information to the party or parties involved in the transaction. JumpTime may also share and/or transfer your User Information to any or all of its affiliated entities (such as any subsidiary or parent).
      • JumpTime may disclose any or all User Information to protect or defend the legal rights or property of JumpTime or its employees, agents and contractors; to protect the safety of the general public, the users of the Site and/or the JumpTime employees, agents and contractors and to investigate, prevent or take action regarding suspected or actual illegal activities or fraud.
  6. PUBLIC AREAS

    If you post or provide any information in any public area on the Site (such as public forums, blogs, discussion boards, etc.) you should be aware that any PII you disclose in such areas can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. JumpTime is not responsible for the PII or other information you choose to disclose in these public areas.

  7. THIRD PARTY LINKED SITES

    The Site may contain links to other websites. By accessing and/or using a linked website, you may be disclosing your personal information to such linked website. Therefore, you should carefully review the privacy policies of these other websites. If you are not comfortable with the policies of a linked website, you should not access and/or use that website. JumpTime is not responsible for the privacy policy, other policies or content of any of the linked websites.

  8. SECURITY MEASURES

    JumpTime uses commercially reasonable and appropriate security measures to protect the PII in JumpTime’s possession from unauthorized access, destruction or use. However, since it is impossible to guarantee the security of data transmission and data storage utilizing the Internet, JumpTime is not responsible for any circumvention or breach of its security measures by any third party. Please note that email communications to and from JumpTime email addresses are not encrypted and if you communicate confidential or sensitive information through such means, you do so at your own risk.

  9. UPDATING YOUR INFORMATION

    If you would like to update or modify any of your PII that you have previously provided to JumpTime, please contact JumpTime at support@jump-time.com.

  10. CHANGES TO THIS PRIVACY POLICY

    JumpTime may from time to time amend this Privacy Policy to reflect changes in our practices and services. If JumpTime makes any material changes to the way JumpTime collects, uses, or shares your PII, we will notify you by posting a notice of those changes on the Site. All changes will be effective upon their posting. Your continued use of the Site following the posting of a change to this Privacy Policy constitutes your agreement to the terms of the revised Privacy Policy. JumpTime encourages you to regularly review this Privacy Policy so that you remain updated as to any changes.
